Terms of Service (ToS) – PopMyPad

SECTION 1 – Scope of Application & Company Info
These Terms of Service (ToS) apply to all sales of products concluded by PopMyPad on the websites https://www.popmypad.com and https://www.popmypad.fr.
Nature of Products: PopMyPad specializes in high-quality mouse pads, including XXL, RGB, ergonomic and custom models. These terms govern sales to individual consumers (B2C) and, secondarily, to professional clients or esports organizations (B2B), unless a separate contract is agreed upon.
By placing an order, the customer declares that they have read, understood and accepted these Terms of Service.

SECTION 2 – Prices, Sales Tax & Customs
Prices are always displayed in the currency of the market you are shopping from. Orders placed on https://www.popmypad.com are priced, invoiced and charged in US Dollars ($); no order placed on that store is ever billed in another currency.
Tax Regulation: Prices are displayed net of tax. Value Added Tax (VAT) is not applicable, in accordance with Article 293 B of the French General Tax Code (CGI). Shipping fees are calculated when the shopping cart is validated.
Sales Tax, Duties & Customs: Displayed prices exclude shipping fees, local sales taxes and customs duties. For all orders shipped outside the European Union, including the United States, the customer is the importer of record and is solely responsible for declaring and paying any sales or use taxes, import duties or customs clearance fees required by their state or local jurisdiction.
PopMyPad reserves the right to modify its prices at any time, but products are invoiced at the rates in effect at the moment the order is validated.
SECTION 3 – Orders and Customization
The sales contract is legally validated upon receipt of full payment. For custom mouse pads, production begins immediately after technical validation. Because of the automated nature of our production chain, no changes to the uploaded artwork, design or layout can be made once the order enters the manufacturing phase.
SECTION 4 – Payment Terms and Late Fees
Accepted payment methods include major credit cards (Visa, Mastercard) and PayPal. All transactions are secured with industry-standard encryption protocols.
B2B Clause: For professional clients, any late payment automatically results in late payment penalties equal to three (3) times the legal interest rate in effect, plus a flat recovery fee of €40, in accordance with Article L441-10 of the French Commercial Code.
SECTION 5 – Shipping and Delivery
Products are shipped to the address provided at checkout. PopMyPad guarantees delivery within a maximum of 30 days. The customer is entirely responsible for the accuracy of the shipping address provided. If a package is returned to our hub because of an incorrect or incomplete address, or because it was not collected from the carrier, all re-shipping fees are charged to the customer.
SECTION 6 – Transfer of Ownership and Risk of Loss
Ownership of the products transfers to the customer only after full and complete payment of the purchase price, regardless of the delivery date.
In accordance with consumer protection regulations, the transfer of risk (loss, theft or damage) occurs at the exact moment the customer, or a third party designated by the customer, takes physical possession of the package. Products therefore travel at PopMyPad's risk until they are physically delivered to you.
SECTION 7 – Return Policy, Right of Withdrawal & Final Sales
A. United States & International Customers: For non-custom products, a 14-day return window from the delivery date is granted, provided the item is completely unused, unopened and in its intact original packaging. Return shipping costs to our facility in France are the sole responsibility of the customer.
B. European Union Customers (Right of Withdrawal): EU consumers have 14 days from the delivery date to exercise their legal right of withdrawal for non-custom products, with return shipping at the customer's expense.
⚠️ STRICT EXCLUSION – CUSTOM PRODUCTS: In accordance with Article L221-28 of the French Consumer Code and standard international e-commerce practice, all sales of custom mouse pads (printed with your own image, logo, photo or text) are strictly FINAL. They cannot be returned, exchanged or refunded for a change of mind. They are eligible for replacement or credit only if they arrive physically damaged or with a proven manufacturing defect.
SECTION 8 – Warranties & Color Tolerance
Legal Protections (EU): EU customers benefit from the Legal Warranty of Conformity (2 years) and the Warranty against Hidden Defects under the French Civil Code.
Color and Printing Tolerance: The customer acknowledges that the final print on textile and rubber surfaces may vary slightly in contrast, brightness and color rendition compared with the digital preview shown on a computer monitor or phone screen (RGB versus CMYK printing profiles). These minor variations are inherent to the printing process and do not constitute a product defect or non-conformity.
SECTION 9 – LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POPMYPAD, ITS DIRECTORS, OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE PRODUCTS.
IN NO EVENT SHALL POPMYPAD'S TOTAL LIABILITY FOR ALL CLAIMS EXCEED THE EXACT AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC ORDER GENERATING THE LIABILITY.
SECTION 10 – Intellectual Property and Customer Indemnification
All content, designs and branding elements on the website are the exclusive property of PopMyPad. Any reproduction is strictly prohibited.
Customer Copyright Warranty: When uploading an image, logo or design for a custom mouse pad, the customer expressly warrants that they own the intellectual property rights, trademarks or commercial licenses required for that artwork.
Indemnification: PopMyPad operates strictly as a printing execution service and declines any liability regarding trademark or copyright infringement related to customer-uploaded files. The customer agrees to defend, indemnify and hold harmless PopMyPad and its owner against any claims, damages, legal fees or lawsuits brought by a third party as a result of the unauthorized or illegal use of artwork provided by the customer.
SECTION 11 – Governing Law and Jurisdiction
These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of France, without regard to conflict of law principles.
Any dispute arising from the interpretation, execution or validity of these terms that cannot be resolved through an amicable customer service process shall be subject to the exclusive jurisdiction of the competent courts of France.
