General Terms and Conditions of Sale (GTC) - PopMyPad

ARTICLE 1 – Scope of Application

These GTC apply to all product sales concluded by PopMyPad on the website https://www.popmypad.fr.

Nature of products: PopMyPad specializes in mouse pads (XXL, RGB, ergonomic, and customizable). These conditions govern sales to individual customers (B2C) and, secondarily, to professional customers or esports organizations (B2B), unless a specific derogating contract is in place.

By placing an order, the customer declares to have read and accepted the GTC.

ARTICLE 2 – Prices

Prices are indicated in Euros, net of tax. VAT is not applicable in accordance with article 293 B of the CGI. They exclude processing and shipping fees, calculated when the cart is validated. PopMyPad reserves the right to modify its prices at any time, but products are invoiced based on the rates in effect at the time of order validation.


ARTICLE 3 – Orders and Customization

The sales contract is validated upon full payment. For customized mouse pads, production begins immediately after technical validation. No visual modification is possible once the order has entered the manufacturing phase.


ARTICLE 4 – Payment Methods and Delays

Accepted methods: Credit card (Visa, Mastercard) and PayPal. Payments are secured by encryption.

B2B Clause: For professional customers, any payment delay will automatically result in the payment of late penalties equal to 3 times the legal interest rate, as well as a lump sum indemnity of €40 for recovery costs (Art. L441-10 of the Commercial Code).


ARTICLE 5 – Delivery

Delivery within a maximum period of 30 days. The customer is responsible for the accuracy of the address provided. In case of return due to an incorrect address or unclaimed package, re-shipping costs will be borne by the customer.


ARTICLE 6 – Transfer of Ownership

The transfer of ownership of the products to the customer will only be realized after full payment of the price by the latter, regardless of the delivery date of said products.

In accordance with legal provisions, the transfer of risks of loss and deterioration related thereto will only be realized when the customer, or a third party designated by him, takes physical possession of the products. The products therefore travel at the risk and peril of PopMyPad until their physical delivery to the customer.


ARTICLE 7 – Right of Withdrawal and Exceptions

In accordance with the law, the customer has 14 days to withdraw (return costs at their expense).

⚠️ IMPORTANT EXCEPTION: In accordance with article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for products made to the consumer's specifications or clearly personalized. Personalized mouse pads (logos, photos, specific dimensions) cannot be returned, exchanged, or refunded, except in the case of a proven manufacturing defect.


ARTICLE 8 – Guarantees and Technical Limits

Products benefit from legal guarantees (conformity and hidden defects).

Color tolerance: The customer acknowledges that the color rendering may vary slightly between the screen display (RGB profile) and the final print on textile/rubber. These minor variations do not constitute a defect of conformity.


ARTICLE 9 – Personal Data (GDPR)

Data is collected for order processing and is never transferred to third parties. In accordance with the GDPR, you have the right to access and delete data via contact@popmypad.fr.


ARTICLE 10 – Intellectual Property and Responsibility

The content of the site is the property of PopMyPad. Any reproduction is prohibited.

Customer's responsibility: The customer guarantees that they hold all rights (copyright, trademarks) to the images submitted for customization. PopMyPad disclaims all responsibility in the event of infringement proceedings initiated by a third party. The customer undertakes to indemnify PopMyPad against any damage resulting from the illegal use of a visual.


ARTICLE 11 – Applicable Law and Disputes

French law. In case of dispute, an amicable solution is preferred. Failing this, the customer may refer the matter to the consumer mediator or the ODR platform: https://www.mediationconso-ame.com//
